Clause 11: Payment Terms

1. Draft L/C/DLC/SBLC issuance:

   • Within 3 (three) banking days after signing the contract, the buyer shall issue a draft L/C/DLC/SBLC for the seller’s beneficiary’s bank approval.
   • (L/C takes approximately 7 (seven) days to be released).

2. Seller’s Confirmation:

   • Upon receiving the draft, the seller shall confirm the contents of the L/C/DLC/SBLC and reply within 1 (one) banking day to the buyer’s bank.

3. Final L/C/DLC/SBLC Issuance:

   • Within 7 (seven) banking days after signing the final contract, the buyer’s bank shall issue SBLC MT 760/DLC MT 700, L/C at sight, transferable, conditional, and irrevocable, payable at sight to any bank via a negotiation L/C to the seller’s beneficiary’s bank.
   • The issuing bank shall confirm the L/C to the seller’s/beneficiary’s bank by SWIFT.
   • The buyer/applicant shall strictly follow the seller/beneficiary bank’s format verbiage provided by the seller.

      

4. Bank Charges:

   • All bank charges of the issuing bank are the buyer’s responsibility.
   • All bank charges outside the issuing bank, including reimbursement charges, are the seller’s responsibility.

      

5. Irrevocable Transferable L/C/DLC/SBLC Terms and Conditions:

   • The L/C/DLC/SBLC shall be opened by a reputed Prime Bank.
   • The L/C/DLC/SBLC shall allow for 10% more or less in value and quantity.
   • L/C/DLC/SBLC PAYABLE AT SIGHT 100% at loading port.
   • Irrevocable and transferable.
   • All bank charges outside the opening bank shall be borne by the SELLER.
   • Third-party documents are acceptable.
   • Spelling, typographical errors, or discrepancies of such nature between bank-issued and beneficiary-issued documents shall not be considered discrepancies.
   • All documents must be issued in English.
   • Partial payments and partial shipments are allowed.
   • T/T reimbursement is allowed.
   • The advising bank is authorized to transfer the L/C/DLC/SBLC.
   • 42C Draft: Specific conditions to be inserted.
   • B/L showing Charter Party Date prior to L/C/DLC/SBLC issuing date is acceptable.
   • Documents under the L/C/DLC/SBLC must be presented within 30 (thirty) days after the shipment date.
   • Documents issued earlier than the L/C date are acceptable, except for the Charter Party Date.

6. Additional Instructions:

   • F78: Instructions to the Paying, Accepting, and Negotiating Bank:
     Upon receipt of compliant documents, we will remit proceeds on a sight basis, less USD XX as a handling fee.
   • P49H: Usance drafts to be negotiated on a sight basis; usance interest shall only be between the applicant and the issuing bank.
   • The L/C/DLC/SBLC is subject to UCP (2007 Revision, ICC Publication No. 600).

Clause 12: Documentation Required for  LC/DLC/SBLC Negotiation (100% Payment at Loading Port)

The seller shall supply the following documents promptly to the buyer for L/C/DLC/SBLC negotiation within the validity period of the L/C/DLC/SBLC:

1. Within 7 (seven) banking days after signing the final contract, the buyer’s bank shall issue SBLC MT 760/DLC MT 700, L/C at sight, transferable, conditional, irrevocable, and payable at sight to any bank by negotiation L/C to the seller’s beneficiary’s bank. The issuing bank must confirm the L/C/DLC/SBLC to the seller’s/beneficiary’s bank by SWIFT. The buyer/applicant must strictly follow the seller/beneficiary bank’s format verbiage as provided by the seller.

2. Required Documents for L/C/DLC/SBLC Negotiation (46A):
   The following documents must be presented for payment under the L/C/DLC/SBLC:

   • Commercial Invoice: 1 (one) original signed by the beneficiary and 3 (three) copies.
   • Beneficiary Certificate: Certifying that the Bill of Lading (B/L) documents must be presented within 14 (fourteen) banking days after the shipment date.
   • Draft Survey Certificate: 1 (one) original plus 2 (two) signed copies issued by Surveyor CCIC at the loading port.
   • Certificate of Analysis (COA): 1 (one) original plus 2 (two) signed copies from Surveyor CCIC at the loading port.
   • Certificate of Origin (COO): 1 (one) original from the relevant authority.
   • Certificate of Weight (COW): 1 (one) original plus 2 (two) signed copies from Surveyor CCIC at the loading port.
